Terms of Service

These terms govern Munch, including the website, account portal, Free and Premium capabilities, household workspaces, billing, OAuth connections, and MCP tools.

1. The Munch service

Munch is a consumer wellness service that gives ChatGPT and compatible MCP clients authorized tools for food search, nutrition records, saved foods, recipes, meal calendars, grocery lists, household collaboration, water and weight tracking, and factual summaries.

Munch is not a standalone AI model and does not control ChatGPT. OpenAI's products, plans, policies, availability, and model behavior are separate from Munch.

2. Free access, Premium, and cancellation

Munch Free provides permanent core access without a payment method, subject to the limits shown on the Munch website. Connecting Munch to ChatGPT does not require Premium.

Munch Premium is an optional subscription purchased independently on the Munch website for $4.99 per month, plus applicable taxes. The paid subscription begins when Stripe confirms checkout and renews each month until canceled. You authorize Stripe to charge the saved payment method for recurring fees and applicable taxes.

Payment methods, invoices, and cancellation are managed through the Stripe-hosted customer portal linked from the Munch account portal. Cancellation normally takes effect at the end of the current paid period unless Stripe or applicable law provides otherwise. Canceling Premium does not delete the Munch account or personal data; the account returns to applicable Free capabilities.

Promotions, refunds, and credits may be limited. Except where required by law or expressly stated, fees already charged are non-refundable.

3. Household workspaces

A directly eligible Premium account may create and own one household subject to the current member limit. The owner can invite accounts as members or viewers. Members may edit shared records while viewers are read-only. Household access depends on the owner's applicable entitlement. If the owner enables paid household seats, the owner's Premium subscription covers the owner and each active additional member adds the current recurring seat price shown on the Munch website (currently $2.00 per month per seat), with applicable proration. Pending invitations are not billed until accepted. Household-provided Premium ends if the owner's entitlement or seat coverage ends; a member's independent Premium remains separate.

Household recipes, planned meals, grocery lists, display names, roles, and factual activity attribution are visible to active household members. Personal meals, water, weight, personal saved foods, and personal goals remain private unless the user deliberately creates a record in the shared household workspace.

Household members are responsible for inviting only people they are authorized to include and for the information they place in the shared workspace. A household owner must transfer ownership or dissolve the household before deleting the owner's account. Dissolution permanently deletes shared household records. A former member's display-name attribution may remain with shared activity as described in the Privacy Policy.

4. Nutrition estimates and no medical advice

Munch may use USDA FoodData Central, Open Food Facts, saved foods, recipes, prior confirmed meals, user-provided information, and AI-assisted estimates. Records can be incomplete, outdated, mislabeled, or based on assumptions. Restaurant preparation, portion size, recipes, and product reformulation can materially change actual nutrition.

Munch and ChatGPT outputs are not medical advice, diagnosis, treatment, emergency guidance, or a substitute for a physician or registered dietitian. Do not rely on Munch for allergy safety, medication interactions, eating-disorder treatment, emergency decisions, or clinical dosing.

5. Account, invitation, and connection security

You are responsible for controlling access to your email account, Munch session, ChatGPT account, connected MCP clients, household invitation links, and devices. Notify Munch of suspected unauthorized access and revoke affected connections promptly.

You must provide accurate information and may not impersonate another person, accept an invitation sent to another email address, transfer access deceptively, or attempt to bypass authorization, plan limits, rate limits, or database isolation.

6. Acceptable use

You may not use Munch to:

  • Break laws or infringe another person's rights.
  • Probe, exploit, disrupt, overload, scrape, reverse engineer, or bypass security controls.
  • Access another account's personal or household records or credentials without authorization.
  • Upload malware or automate abusive traffic.
  • Represent Munch output as certified medical, clinical, or laboratory analysis.
  • Resell the hosted service or create competing bulk data services without written permission.

7. Third-party services and open-source software

Munch depends on services operated by OpenAI, Stripe, Railway, Resend, USDA FoodData Central, Open Food Facts, and other infrastructure providers. Their terms and availability apply separately.

Munch began as a fork of the MIT-licensed Nutrition MCP project by Alexander Kutishevsky. Open-source licenses and notices remain applicable to their respective components. The hosted Munch service is independent and is not endorsed by the original developer.

8. Changes and availability

Munch may modify tools, Free limits, supported clients, food sources, household limits, Premium pricing for future periods, security requirements, or the service itself. Reasonable notice will be provided for material subscription changes when required.

The service may be interrupted by maintenance, provider outages, security incidents, data-source failures, model behavior, marketplace review, or other conditions. No guarantee is made that every ChatGPT plan or client will support Munch.

9. Suspension, cancellation, and termination

Munch may suspend or terminate access for abuse, security risk, legal requirements, material breach, or discontinued service. Premium capabilities may be restricted for nonpayment while applicable Free capabilities remain available unless the account is otherwise suspended.

You may stop using Munch, cancel Premium, revoke connections, export data, leave or dissolve a household as applicable, and delete the account through available controls. Deleting a Munch account does not automatically cancel an active Stripe subscription or erase Stripe's legally required billing records.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, Munch is provided "as is" and "as available" without warranties of accuracy, availability, merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Munch and its contributors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, health outcomes, lost profits, or reliance on nutrition estimates. Aggregate liability arising from the service will not exceed the amount paid for Munch during the three months before the event giving rise to the claim.

11. Governing law, consumer rights, and contact

These terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Any dispute that must be resolved in court will be brought in a state or federal court with jurisdiction in South Carolina, except where applicable consumer law requires another forum. Consumer rights that cannot lawfully be waived remain unaffected.

Do not place sensitive nutrition, household, or account information in public GitHub issues. Send support and legal notices to support@munch.business. Munch may send service and legal notices to the email address associated with the account.

Changes to these terms

Updated terms will be posted with a revised date. Continued use after an effective update constitutes acceptance where permitted by law.
